This site is owned by Tamarack Outdoors and registered in England, with registered address at Brook House Buildings, Hall Lane, Great Eccleston, Lancashire, PR3 0XN.

These terms and conditions are intended to define the rights and obligations of the parties in the sale of goods proposed online by Tamarack Outdoors for the customer.

These terms and conditions apply to the use of the Tamarack Outdoors website and by accessing the website and/or placing an order you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions, you may not use or access this Website.

You are confirming by accepting the terms and conditions that you are over 18 for the purpose of purchasing any knife on our site.

None of these terms affect your legal rights and these are not diminished in any way. If any term is held to be invalid under any applicable statute or rule of law, that term is automatically omitted from the terms to minimum extent necessary to comply with the law and without affecting the validity or enforceability of the remainder.

At Tamarack, we understand that we have a responsibility to protect and respect your privacy and look after your personal data.

This Privacy Notice, inclusive of our General Terms of Service, explains what personal data we collect, how we use your personal data, reasons we may need to disclose your personal data to others and how we store your personal data securely.

For clarity, Tamarack may be both data controller and data processor for your personal data under certain circumstances.

Who are we?
Tamarack is a provider of Outdoor equipment and services, based in Barancre. Tamarack have a registered office at Unit 4 , Creamery Industrial Estate, Kenlis Road, Barnacre, Lancashire, PR3 1GD. Sally Rushton is the registered Data Protection Officer for Fasthosts.

How the law protects you
Data protection laws state that we are only able to process personal data if we have valid reasons to do so. The basis for processing your personal data includes, but is not limited to, your consent, performance of a contract, to enable billing and remittance, and to contact you for customer service purposes.

We receive information about you from you when you use our website, complete forms on our website, if you contact us by phone, email, or otherwise in respect of any of our products and services or during the purchasing of any such product. Additionally we also collect information from you when you sign up, enter a competition, promotion or survey or when you inform us of any other matter.

The personal data that we may collect from you includes your name, address, email address, phone numbers. We may also keep details of your visits to our site including, but not limited to traffic data, location data, weblogs and other communication data. We also retain records of your queries and correspondence, in the event you contact us.

Retention periods

On the closure of your account, we may keep your data for up to 7 years after you have cancelled your services with us. We may not be able to delete your data before this time due to our legal and/or accountancy obligations. We may also keep it for research or statistical purposes. We assure you that your personal data shall only be used for these purposes stated herein.

Third Parties
For the avoidance of doubt, we do not and never shall sell your personal data to third parties for marketing or advertising purposes.
We may pass your personal data to third parties for the provision of services on our behalf (for example processing your payment). However, we will only ever share information about you that is necessary to provide the service and we have specific contracts in place, which ensure your personal data is secure and will not be used for any marketing purposes.

In preventing the use or processing of your personal data, it may delay or prevent us from fulfilling our contractual obligations to you. It may also mean that we shall be unable to provide our services or process the cancellation of your service.
You have the right to object to our use of your personal data, or ask us to delete, remove or stop using it if there is no need for us to keep it. This is known as your right to be forgotten. There are legal and accountancy reasons why we will need to keep your data, but please do inform us if you think we are retaining or using your personal data incorrectly.

Where we store your personal data
We follow accepted ISO standards to store and protect the personal data we collect, including the use of encryption if appropriate.
All information you provide to us is stored on our secured servers within the EEA. From time to time, your information may be transferred to and stored in a country outside the EEA in relation to provision of the services. The laws in these countries may not provide you with the same protection as in the EEA; however, any third party referred to above outside of the EEA has agreed to abide by European levels of data protection in respect of the transfer, processing and storage of any personal data. By providing your data to us, you agree to this transfer and storage. However, we will ensure that reasonable steps are taken to protect your data in accordance with this privacy notice.
As the transmission of information via the internet is not completely secure, we cannot guarantee the security of your data transmitted to our site and any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.
Any sensitive data (payment details for example) are encrypted and protected.

Although we aim to keep the Tamarack Outdoors Website as up to date as possible, product information appearing on the Website at a particular time may not always reflect the position exactly at the moment you place an order.

Tamarack Outdoors or its suppliers shall not be held liable for the consequences, accidents, or special damages arising from electronic transmissions or the accuracy of transmitted information, even in cases where Tamarack Outdoors was aware of the possibility of such damages.

Manufacturer and brand names are only used for identification purposes. Product photos, descriptions and prices are non-contractual

ORDERING, CANCELLING OR RETURNING A PRODUCT
Contract Creation
Payment is taken for your order at the time the order is made. In the event we are unable to supply the item a full refund would be made .

When confirmation of your order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. 
 
We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in case of the following:
 - a mistake has been made in pricing or we have inadvertently under-priced goods*
 - we are no longer able to supply a particular product for some reason
 - we are unable to obtain authorisation for your payment

*In the case of a change of price, we will always contact you first to ensure that the price is acceptable.

All contractual information will be confirmed by email to the address specified by the customer during the purchasing act.

The records stored in Tamarack Outdoors systems under reasonable safety conditions are considered proof of communications, orders and payments made between the parties. Purchase orders and invoices are stored on a reliable and durable system and can be produced as evidence.

Consumer Contracts Regulations
This legislation offers you the following cancellation rights when you buy online or by phone:

- You are entitled to cancel your contract if you so wish, provided that you exercise your right no longer than 14 days after the day on which you receive the goods or services.

- Your right to return products does not apply to goods made to your specification, that have been clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly.

- If you wish to exercise your right of cancellation, you are obliged to retain possession of the goods and take reasonable care of them.

- To exercise the right to cancel, you must inform us of your decision to cancel your contract by a clear statement, including details of your name, geographical address, details of the order you wish to cancel and, where available, your phone number and email address.

- If you decide to cancel, you should return the goods to us at your cost within 14 days of such cancellation and we will reimburse to you (by the method used to pay for the original transaction) the amount in relation to goods to which cancellation rights apply. This excludes the cost of delivery where paid if the order is below our free postage threshold of £50 (except for the supplementary costs arising if you choose a type of delivery other than our standard and least expensive method of delivery).

- We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied.

Tax Charges
Vat at 20% is included in all orders made in the UK.

If ordering from a NON EU country no VAT is payable, as it is deducted prior to completion of the order. For overseas ordering there may be a duty charge to be paid by you on delivery of the item, and by agreeing to the terms and conditions you are accepting this.

We guarantee your satisfaction. All of our products come with a 30 day no quibble guarantee.

Validity Period of Offer and Prices
Our offers and prices are valid for the day the site is consulted and are subject to change without notice.


Cancelling or Changing an Order

DELIVERY
Delivery Schedule and Postage can be found on our Delivery Schedule page.

Products are delivered to the address specified by the customer on the purchase order and only to geographic zones that we service.

All products leave our premises in perfect condition. The customer must notify the carrier (or postman) of even the slightest trace of damage (holes, signs of crushing, etc.) to the parcel, and refuse the package if necessary. A new, identical product will then be sent to the customer at no additional charge.

No exchanges can be made at a later time for goods claiming to be damaged during carriage without notification at the time of reception.

As with any shipment, a delay or loss of goods is possible. In such a case, the carrier shall start an investigation. Every effort is made, for as long as necessary, to find the package. If the package is not found, the carrier will reimburse Tamarack Outdoors, who will deliver a new, identical package to the customer free of charge.

We shall not be held responsible for delayed delivery times due to the carrier, including for the loss of goods, bad weather or strikes.

Loss or Damage in Transit
Tamarack Outdoors will not be responsible for damage or loss of goods or part thereof in transit or for any discrepancy between the goods delivered and the goods ordered unless the customer gives written or email notice of a claim to Tamarack Outdoors and the carrier within three business days of delivery.

In the event of damage of goods or part thereof in transit or for any discrepancy between the goods delivered and the goods ordered, the customer must hold the goods and make them available for inspection or collection by Tamarack Outdoors or its representatives on request.

Delivery Errors
The customer must inform Tamarack Outdoors immediately (the same day or, at the latest, the first business day following delivery) concerning any claim of delivery error or non-conformity of goods, in kind or in quality, compared with the information on the purchase order.

Any claim made after this time period will be rejected.

For all claims the customer must make a declaration, and receive consent from Tamarack Outdoors. All claims must be made in writing and sent to Tamarack Outdoors, details can be found on our Contact Us page.

Any claim that does not respect the rules defined above cannot be taken into account and releases Tamarack Outdoors of any responsibility to the customer.

In the case of delivery error or exchange, all goods to be exchanged or refunded must be returned in whole, in its original packaging and in perfect condition to the Tamarack Outdoors address. Details can be found on our Contact Us page.

Shipping fees shall be at Tamarack Outdoors expense, except in the case where the goods do not correspond to the original declaration made by the customer concerning the return.


WARRANTY
The provisions hereof cannot deprive the customer of their right to legal warranty requiring Tamarack Outdoors to protect the customer against latent defects of goods sold.

The customer is expressly informed that Tamarack Outdoors is not the manufacturer of the goods presented on the Website and that Tamarack Outdoors shall not be held liable for defective goods.

In the case of damage to a person or property resulting from a product defect, only the product manufacturer shall be held liable and sought after by the customer, by means of the information provided on the packaging of said product.

All products sold on the Tamarack Outdoors Website are covered by the individual manufacturers warranty. All products that have been modified or repaired by the customer or any other party not chosen by Tamarack Outdoors are not covered by this warranty.

The use of any trademarks, logos or brands present on the site is strictly forbidden.

Force Majeure
Neither party will be deemed to be in breach of any of its obligations under the agreement as a result of any delay in performing or any failure to perform any such obligations by reason of any cause or event beyond the parties' control. A force majeure event includes, but is not limited to, any unforeseeable, inevitable, or unstoppable act, event, non-happening, omission or accident beyond the control of either party, despite all reasonable efforts made to the contrary. In addition to events usually recognized by the British courts, a force majeure event includes in particular (without limitation) the following: Strike, lock-out, earthquake, fire, storm, flood, lightning, explosion, impossibility of the use of public or private telecommunications networks.

In such circumstances, the party delayed or unable to perform ("Delayed Party") shall notify the other party ("Affected Party") within ten (10) business days following the date such events become known.


Unless prevented due to force majeure, both parties will meet within three months to examine the impact of the event and agree to the conditions under which the contract shall be continued. If the force majeure lasts longer than one (1) month, this agreement may be terminated by the injured party.

Partial Invalidity
These terms and conditions remain valid and in force, even if one or more clauses are invalid or declared so under any law, regulation or following the final decision of a competent court.

Non-Waiver

No failure of either party to exercise any power given to it in these terms and conditions or to insist upon strict compliance by the other party with its obligations hereunder shall constitute a waiver of either party's right to demand exact compliance with the terms hereof.

Applicable Law and Competent Jurisdiction
In case of dispute or claim, the customer agrees to seek an amicable solution with Tamarack Outdoors before proceeding with any legal action. In the event where such a solution cannot be found, any disputes concerning the sale (price, Terms and Conditions, products, etc.) will be subject to the exclusive jurisdiction of the English courts.
